❓勞動節補假怎麼補

根據勞基法規定,5月1日為勞工之 #國定假日,而今年5月1日勞動節剛好適逢週六,可能遇到勞工 #例假日 或 #休息日,補假日期由勞資雙方協商。

 

❓補假薪資如何計算

勞動節當日若遇勞雇雙方原約定的休息日,若勞雇雙方約定於4月30日補假,補假當天性質即為國定假日。

👉勞工若同意於補假當日出勤,國定假日出勤8小時以內者,雇主就應於原月薪外,另再加給1日工資。

👉勞工若在5月1日休息日出勤8小時,雇主則應提供休息日加班費。

⚠以上適用於事業單位如屬週一至週五為工作日、週六為休息日、週日為例假的出勤模式。

❓How to make up for the Labor Day holiday

❓How to calculate the compensation leave salary

If Labor Day corresponds to the rest day originally agreed by the employer and the employee, and if both parties agree to make up the holiday on April 30, the day of the supplementary holiday will be categorized as a national holiday.

👉If the worker agrees to work on the day of the compensatory leave, the employer shall pay an additional day’s salary in addition to the original monthly salary if the employee has been on duty for a time span of maximum 8 hours on the national holiday.

👉If the worker works for 8 hours on the May 1 rest day, the employer should provide overtime pay for the rest day.

⚠The above is applicable to the attendance mode of public institutions where Monday to Friday are working days, Saturday is a rest day, and Sunday is an official holiday.
