移工應於聘僱許可期間屆滿前,與原雇主協議是否續聘,並注意下列事項:
1.如移工與雇主協議,不繼續聘僱並欲返國,倘於聘僱期滿14日前進行解約,應辦理解約驗證,並由原雇主協助移工返國。
2.如移工與雇主協議期滿續聘,原雇主應於聘僱許可期間屆滿2個月至4個月前,向勞動部申請期滿續聘。
3.如移工與雇主協議,不繼續聘僱,並於期滿轉換雇主,則原雇主於聘僱許可期間屆滿2個月至4個月前,應向勞動部申請期滿轉換。
4.如移工發生轉換由新雇主接續聘僱者,請敦促新雇主應辦理接續聘僱許可。
Sebelum masa izin perekrutan berakhir, Anda dapat bernegosiasi dengan majikan apakah akan memperpanjang kontrak kerja, serta memperhatikanhal-hal sebagai berikut:
1. Jika Anda dan majikan setuju untuk tidak memperpanjang kontrak kerja dan kembali ke negara asal,apabila pemutusan kontrak kerja lebih dari 14 hari sebelum masa kontrak berakhir, maka harus mengurus verifikasi pemutusan kontrak kerja dan proses pulang kembali ke negara asal akan dibantu oleh majikan.
2. Jika Anda dan majikan setuju untuk memperpanjang kontrak kerja, maka 2-4 bulan sebelum masa kontrak kerja berakhir dapat mengajukan permohonan perpanjangan kontrak kerja.
3. Jika Anda dan majikan setuju untuk tidak memperpanjang kontrak kerja, setelah masa kontrak kerja berakhir akan proses pindah majikan maka 2-4 bulan sebelum masa kontrak kerja sebelumnya berakhir dapat mengajukan permohonan perpanjangan kontrak pindah majikan
4. Jika telah pindah ke majikan baru, maka meminta majikan baru untuk mengurus surat izin perekrutan.

คุณต้องตกลงกับนายจ้างว่าจะต่อสัญญาหรือไม่ก่อนใบอนุญาตทำงานจะหมดอายุและต้องใส่ใจกับเรื่องต่อไปนี้:
1.ถ้าคุณตกลงกับนายจ้างไม่จ้างต่อและต้องการกลับเมืองไทยหากยกเลิกสัญญาเกิน 14วันก่อนใบอนุญาตจะหมดอายุต้องไปทำการยกเลิกสัญญาที่กองแรงงานเขตและนายจ้างต้องจัดการเรื่องการเดินทางกลับประเทศ
2.ถ้าคุณตกลงกับนายจ้างจะจ้างต่อนายจ้างเดิมต้องไปยื่นเรื่องขอต่อสัญญาที่กระทรวงแรงงานภายใน2เดือนถึง4เดือนก่อนครบสัญญา
3.ถ้าคุณตกลงกับนายจ้างไม่จ้างต่อแล้วจะเปลี่ยนนายจ้างใหม่ต้องให้นายจ้างเดิมไปยื่นเรื่องขอเปลี่ยนนายจ้างในกระทรวงแรงงานภายใน2เดือนถึง4เดือนก่อนวันครบสัญญา
4.ถ้าเปลี่ยนนายจ้างใหม่แล้ว โปรดเตือนนายจ้างใหม่ไปขอใบอนุญาตทำงานต่อ
You must talk to your employer before the end of your employment permitand ask if you will be rehired. Please take note of the following:
1. If you talk with your employer and you decide not to continue employment and decide to go home 14 days or more before the end of your contract, you must have your termination verified and your employer must assist you for arrangements going home.
2. If you talk with your employer and reach an agreement that you will be rehired after end of your contract, the original employer must submit the application for continuous rehiring to the Ministry of Labor at least 2 to 4 months before the end of the validity of your employment permit.
3. If you talk with your employer and employer will not employ you, you will change your employer at the end of your contract. The original employer must submit the application for change of employer to the Ministry of Labor at least 2 to 4 months before the end of the validity of your employment permit.
4. If you transfer and change employer, remind your new employer to apply for employment transfer permit.
Trước khi hợp đồng lao động mãn hạn, bạn nên thỏa thuận với chủ thuê về việc có tiếp tục tuyển dụng nữa hay không, đồng thời chú ý c ác vấn đề dưới đây:
1. Nếu bạn và chủ thuê thỏa thuận, không tiếp tục tuyển dụng và muốn về nước, nếu bạn chấm dứt hợp đồng trước thời hạn 14 ngày, phải làm thủ tục chứng nhận chấm dứt hợp đồng trước thời hạn và chủ thuê giúp bạn làm thủ tục về nước.
2. Nếu bạn và chủ thuê thỏa thuận mãn hạn hợp đồng tiếp tục tuyển dụng, trước khi hợp đồng lao động đến hạn từ 2 đến 4 tháng, chủ thuê phải nộp đơn cho Bộ Lao động làm thủ tục mãn hạn tiếp tục tuyển dụng.
3. Nếu bạn và chủ thuê thỏa thuận, không tiếp tục tuyển dụng, nhưng khi mãn hạn hợp đồng sẽ chuyển đổi chủ, trước khi hợp đồng lao động đến hạn từ 2 đến 4 tháng, chủ cũ phải nộp đơn cho Bộ Lao động xin cấp phép mãn hạn chuyển đổi chủ.
4. Nếu bạn được chủ mới tiếp nhận tuyển dụng, xin hãy thúc giục chủ mới nộp đơn xin cấp giấy phép tiếp nhận tiếp tục tuyển dụng.
