老闆,你要資遣你要先講

依法資遣員工,正確的預告期間是以雇主通知勞工之 ➡次日起算,依曆計算至勞工依約應提供勞務之最後一日止⬅。

例如:

雇主因具有📘勞動基準法第11條規定情事,需資遣勞工。

並預定勞工應提供勞務之最後一日為110年4月21日

該勞工的工作年資為2年6個月(計算至110年4月21日止),

其預告期間須符合20日的預告期限。

解職日前20日為4月2日,則最晚需於110年4月1日預告勞工。

Hi boss, if you want to layoff someone, you have to mention it first

The proper lead-time for notifying employees of the layoff shall be the period from the day after the notice to the last day of service of the employees under the employment agreement in calendar days.

For example: 

If the employer has to lay off the employee pursuant to Article 11 of the Labor Standard Act

And the last day of service of the employee is planned on 2021/04/21

The seniority of service of the employee is 2 years and 6 months (to 2021/04/21).

Then the employer must give 20 days of notice to the employee.

20 days prior to the day of severance is 04/02, which means that the employer must notify the employee no later than 2021/04/01.
